Child Dies in Septic Tank While Under Care of Babysitter

A three-year-old Indiana girl, Kenna Wilson, was discovered dead in a septic tank. At the time of her death, she was under the supervision of her babysitter, who is her mother’s niece.

The event has sparked a complex legal dispute, as Jill Humphries, the mother, struggles with the fact that the prosecutor has decided not to press charges against the babysitter.

The incident unfolded on October 19 when Humphries left her daughter in the care of her niece. Later that day, Humphries received a distressing phone call from her sister, reporting that Kenna was unresponsive. Despite resuscitation attempts, Kenna was declared dead at Norton King’s Daughters’ Hospital in Madison, Indiana, before her mother could reach the hospital.

The following investigation established that Kenna had managed to move the septic tank’s lid and subsequently climbed or fell into it. Ripley County Prosecutor Ric Hertel classified Kenna’s death as an accident, citing the absence of evidence pointing to criminal behavior.

According to Humphries, her daughter was found immersed in sewage and nearly frozen.

The decision to forego criminal charges has caused Humphries significant distress. She says that her niece failed to adequately supervise Kenna, which resulted in her daughter’s death. While she is considering initiating a civil lawsuit, Humphries strongly believes criminal charges should be filed.

This case brings up intricate questions about the distinction between regrettable accidents and criminal negligence, particularly when children are being looked after by minors. Amid her grief, Humphries is also dealing with the death of her sister, which occurred just two days after Kenna’s death. She is adamant about seeking justice for her daughter, whom she remembers as a “joyful and happy little girl.”

Kenna, the youngest of Humphries’ three children, is lovingly commemorated in her obituary. She was characterized as vivacious, imaginative, and a swimming enthusiast. She loved dancing to her favorite tunes, playing with Barbie dolls, and found solace in her teddy bear, Ted. Humphries’ recent social media posts reflect her ongoing struggle to deal with her daughter’s absence, with descriptions of Kenna as “gorgeous and angelic until her last breath.”

The local community has rallied to support Humphries during this challenging time, with friends organizing fundraisers to aid her.
