CNN Hits Trump With Big Ultimatum

A network that has flown with presidents for more than four decades is now being left on the tarmac, and its lawyers have set a deadline.

Theodore “Ted” Boutrous Jr., CNN’s outside counsel and a partner at Gibson Dunn, put his demand letter in front of the Justice Department on Monday, Oct. 19, 2026. The letter gives the government a deadline of 5 p.m. Eastern on Thursday, Oct. 22, to confirm in writing that it will abandon any policy of keeping the network out of the Oval Office and off the president’s plane. The deadline passed with no public word of a Justice Department response, a new court filing or restored Air Force One access.

Boutrous addressed the letter to Michael Velchik, the Justice Department senior counsel representing the Trump administration, and told the department that CNN is prepared to litigate the question for as long as it takes. Without the written confirmation, the network says it will go back to federal court.

Boutrous wrote that “These efforts to retaliate and discriminate against CNN based on the content of its news coverage are mistaken, counterproductive, and unlawful.”

Four Flights, No Explanation Given

Five television networks take turns covering the president aboard Air Force One, and CNN has repeatedly been left off the plane. The letter says the White House denied CNN a spot at least four times with no advance notice and no explanation.

One of those exclusions kept the network off President Donald Trump’s trip to Knoxville, Tenn., on Sept. 26. Most recently the White House blocked CNN from a Trump trip to Georgia and Florida on which the network was scheduled to serve as television pool lead.

Other major networks declined to step into the slot. Presidential travel went forward on some days with no primary television pooler at all.

Trump has been traveling heavily ahead of the November midterms, campaigning for Republican candidates around the country. He stepped off Air Force One at McConnell Air Force Base in Wichita, Kan., on Oct. 19, and landed at Joint Base Andrews, Md., early Oct. 20.

4,700 Questions Outside the Briefing Room

The Oval Office and Air Force One, Boutrous argued, have displaced the James S. Brady Press Briefing Room as the main settings in which the president briefs reporters and takes their questions. CNN compiled data for the letter to make the point.

The count since January 2025 runs past 4,700 questions that Trump has fielded in the Oval Office, aboard Air Force One and on the tarmac. Over the same span, the briefing room produced roughly 150 questions.

The briefing room drew Trump four times in the first nine months of 2026. The Oval Office, by contrast, hosted 43 of his press events over the same span, and he took questions on 51 occasions aboard or alongside Air Force One. Of the nearly 5,000 questions across the three venues, 97% came in the Oval Office or were connected to Air Force One travel.

The White House’s rotating television press pool added CNN in 1981, and the network’s Oval Office and plane access has gone uninterrupted since, according to Boutrous. Those spaces, he wrote, belong to all Americans rather than to any administration, and reporters serve there as surrogates for the public.

The White House has given no indication it plans to honor Boutrous’ demand. A constitutional right of access to the Oval Office, Air Force One or other sensitive and private facilities belongs to no person and no journalist, the White House said in a statement.

The White House told the Daily Beast: “When publications lie, fabricate, and ignore the truth, proximity matters less, and they can write their fiction from outside of these secure facilities.”

Passes Restored, Plane Seats Not

Trump barred CNN, MS NOW and Politico from White House grounds on Sept. 18, citing unhappiness with their reporting. National security figured in part in the ban, the Justice Department said later.

A suit from the three outlets followed, alleging violations of the First and Fifth Amendments. A preliminary injunction from U.S. District Judge Tim Kelly then barred the White House from pulling the hard passes of their reporters and other personnel. Kelly found that the blanket ban likely amounted to unconstitutional viewpoint discrimination and that it violated the outlets’ due process rights. The administration is appealing, and that appeal is unresolved. Access to the White House complex came back; seats on the plane did not.

A White House official said after Kelly’s longer-term order that “the Fake News has no place demanding a spot in the President’s Oval Office.”

The Gulf of America Precedent

Kelly’s ruling left unsettled whether the administration may shut outlets out of tighter spaces such as the Oval Office and Air Force One. A case the Associated Press filed in 2025 carries that question, brought after the White House blocked AP reporters from the plane, the Oval Office and other limited-space pool areas over the wire service’s refusal to adopt “Gulf of America” in its style guidance.

A federal judge ordered the White House to restore AP’s access wherever other media were invited, finding viewpoint discrimination. An appellate panel stayed much of that order in June 2025. The panel concluded that the administration was likely to prevail on its claim that restricted presidential spaces are not First Amendment forums opened for private speech, and that discretion over which journalists it admits, viewpoint included, stays with the White House.

Boutrous called the panel’s order non-binding and non-precedential. The AP is still awaiting a decision from the full appeals court, and some of its access has been restored in the meantime.
